上記のタイトルにある表現は、契約書の翻訳、契約書の日本語から英語の翻訳で体験することが多い、契約書にある基本的な構文「ある条件、状況（もしも）の場合、～する等」に必須な表現です。もちろん、契約書の英語から日本語の翻訳でも、これらの言葉が文脈に合わせて訳語として適宜使用されます。翻訳はやればやるほど奥が深いと感じる昨今ですが、今回も、当ブログの主旨である「とりあえず知っておくと便利」という趣旨に沿って、主に作成した訳文など（法律文を除く）通して簡単にみてみます。
1. ～の場合（は）、「～のとき（は）」
契約書や法律文にある基本的な構文の中でも、もっとも使用される表現のひとつではないでしょうか。言葉の意味としては、例えば「～の場合（は）」は、国語辞典をみると「もし、ある事が起こったとき。そうなった折。「万一の—に備える」または「…に関して。…について言えば。」の意味になります。
「もしも～であるなら、もしも～である場合」は、「if」が真っ先に頭に浮かびますが、英文の場合についての表現には、定番のifの他に、when、in the event that、in case that、in case of、in the case that、in the case of、in case where、shouldなどを使うことができます。
では、これらには、ニュアンス的にどんな違いがあるのでしょうか？
文章を作って、その違いを見てみましょう。
What should you do if it rains? これは、仮定を表す最も一般的な表現です。
What should I do when it rains? 主に、起こると予定される状況を表します。
You should bring your umbrella in case it rains? もしも起きた場合の備えてのニュアンスがあります。
You should bring your umbrella in the case it rains? 上記の表現と同じですが、「the」がついているため、起きる可能性が大きくなります。
他には、in case of、in the case ofなどがあり、これらの場合は、その後には名詞が来ます。
In case of system failure, we must prepare how to process it beforehand.
In the case of misunderstanding, we need to discuss this matter.
以下、これらの言葉について契約書や法律文で使われる場合について作成した「if」を使った文例を通じて簡単にみてみます。
(1) ifを使った場合：
This Agreement is legally binding on you if you sign it.
Employees shall perform duties specified in this Agreement if requested by the Company.
If the Contactor has performed the Services under this Agreement, the Contactor shall immediately prepare a work report in the prescribed format each time and submit it to the Customer. (コントラクターは本解約に基づくサービスを実施した場合、その都度、速やかに所定の書式により作業報告書を作成し、カスタマーに提出する。)
If the Licensee fails the payment based on this Agreement, Licensee shall pay to the Licenser the delay damages at an annual interest rate of 15% from the day after the payment date until the payment is fully paid. （ライセンシーが本契約に基づく支払いを怠った場合、ライセンシーは、支払日の翌日から支払いが完了するまでの期間につき年利15％の割合による遅延損害金をライセンサーに支払う）
In advance of any meeting of shareholders, the Board of Directors may, if they so elect, appoint inspectors of election to act at such meeting or any adjournments thereof.
(2) in case that、in case of、in the case that、in the case of、in case whereなどを使った場合：
Either party may terminate this Agreement in case of force majeure. （不可抗力の場合、いずれの当事者も本契約を解除することができる。）
The period of the Service under this Agreement may shortened in a case of emergency.
A store-based distributor of a store selling or providing schedule I pharmaceuticals must assign a pharmacist who assists the store manager in case where the store manager of the store is not a pharmacist. （第一類医薬品を販売し、又は授与する店舗の店舗販売業者は、当該店舗の店舗管理者が薬剤師でない場合には、店舗管理者を補佐する者として薬剤師を置かなければならない。）（医薬品、医療機器等の品質、有効性及び安全性の確保等に関する法律施行規則）
In the event that either party fails any duty under this Agreement and if a breach of this Agreement is not cured even the other party demands to cure such breach within a reasonable period of time, the other party may terminate this Agreement.
なを、基本的には大体の場合、これらは「if」で代替できます。
(3) その他:
should, when
Should any provision under this Agreement be deemed invalid or unenforceable by a competent court, the remainder shall continue in effect as if this Agreement did not contain such invalid or unenforceable portion or provision. （本契約のいずれかの条項が管轄裁判所によって無効または執行不能と判断された場合、残りの条項は、本契約に当該無効または執行不能な部分または条項が含まれていなかったものとして引き続き有効とするものとする。)
All notices provided by either party to other party shall be deemed to have been given when received. （いずれかの当事者が他方当事者に提供したすべての通知は、受領されたときに（時点で）通知されたものとみなされる）
作成した文例についてはとりあえず「知っておくと便利」という観点からのもので、実際にある事例とはかけ離れた内容もあります。
