日常生活でも「～がない」という表現が使われます。国語辞典を見ると「～がない」といってもさまざまな「～がない」があります。例えば、「お金がない：～を持っていない：所有してない」、「それを見たことがない：経験がない」、「彼は家にいない：不在です」、「そのような事実はない：存在しない」等、これら以外にもさまざまな意味あります。（日本語は奥が深い！）
当然ですが、「～がない」という表現を英語に置き換える場合、上記の例では、I have no money （お金がない）、I have never seen it (それを見たことがない)、He is not here.（彼はいない）等で表現されます。もちろん「～がない」＝「No」を文頭や文中につけて表現することもありますが、この用例も含めて、英文契約書の中で使われる「～がない」という表現について良く目にするもの、知っておいて損がないいくつかの単語・用語・表現を*作成した例文を通して見てみます。特に「 物事が存在しない」という意味を中心に、契約書翻訳の観点から見ています。（*一部除く）
1.「No」または「None」を使用した例
None of the parties may assign or transfer any of its or their rights under this Agreement. （いずれの当事者も、本契約に基づく当事者、もしくは各当事者の権利を譲渡または移転することはできない。）
No previous agreements, arrangements or contracts shall apply to this Agreement. （いかなる以前の合意、取り決めまたは契約も本契約には適用されない）
2.「there is no」を使用した例
The Contractor shall assure that there is no impact to business operations if such interruption occurs. （請負業者は、そのような中断が発生した場合でも、事業運営に影響がないことを保証する。）
3.「be free from」を使用した例
「be free from」は、以前にも売買契約書を例にとって「英文契約書の用語、構文（その17）」で取り上げたことがあります。
The Products to be delivered hereunder shall be free from defects and faulty materials and correspond with any sample and conform to any description, instructions, specifications, and other conditions agreed between the parties. （本契約に基づき引き渡される製品は、瑕疵がなく、材料にも欠陥がなく、サンプルと一致し、説明書、指示書、仕様書および両当事者間で合意したその他の条件に準拠する（抄訳））契約書に限らず、技術文書でも良くみられます。
The finished surface shall be free from any burr, scratch, and damage. (仕上げ面には、バリ、引っかき傷、損傷がないものとする)
4.「in the absence of」を使用した例
In the absence of a choice of law under the preceding Article, the formation and effect of a juridical act shall be governed by the law of the place with which the act is most closely connected at the time of the act. （前条の規定による選択がないときは、法律行為の成立及び効力は、当該法律行為の当時において当該法律行為に最も密接な関係がある地の法による。）（法令第8条）
5.「not exist」を使用した例
Any obligation of the Seller of this Agreement to inspect the quality of the transferred products to third party from the Buyer does not exist. (本契約の売主には買主から第三者に譲渡された製品の品質を検査する義務はない。)
「Nothing in」を使用した例
Nothing in this Agreement shall be construed to create any other relationship between the parties hereto. （本契約のいかなる内容も、「両当事者」間にいかなるその他の関係を構築することはない。）この文章は、定型文として良く目にします。
いずれも英文契約書に限らず、経験上、「～がない」の表現が必要な英文のドラフティングを行うときに覚えておくと以外に便利です。なを、「～がない」については、上記以外にさまざまな単語、用語、表現があります。それらはまた別の機会に見てみたいとおもいます。
