今回は、英単語「performance」について契約書翻訳の視点から見てみます。
英語でも「performance」自体は、日常的に良く使われる言葉です。英単語の例にもれず、主なものをだけでも以下のような意味があります。
(1) 行うこと、遂行、履行 (2) 催し物、余興、興行物、ショー (3) 執行、上演、講演、演奏、芸 (4) 達成、成就、実績、(5) 行動、行為、手順、(6) 行為、偉業、功績、(7) 遂行能力、性能、効率。「パフォーマンス」として日本語として定着しているものもあります（例えば、コストパフォーマンス、パフォーマンス（公演、実演等の意味））。
上記の例からもわかるように、「performance」や「perform」が表す意味は、それらが使われている会話や文章の内容と文脈から判断する必要があります。まずは、日常的に使われている「performance」と「perform」の例をいくつか挙げてみます。
1. 日常的に使われている「performance」と「perform」の例
Through our performance in our business, we would like to contribute to society. （業績）
Our company performs market researches.（行う）
Performance improvement is expected in order to accomplish our objectives.（性能）
We wonder how to improve the performance of this device. （性能）
Performance improvement is expected for our device. （性能）
We strive to develop high-performance xxx products to contribute to society.（性能・機能）
To contribute to society, we develop high-performance xxx products. （性能・機能）
We try to make our xxx products more high-performance.（性能・機能）
2. 契約書や法律文書で使われる例のいくつか
法律関係の英単語辞典で「performance」を見るとまず「履行」（perform：履行する）という意味が目に入ってきます。もちろんこれ以外のさまざまな意味にも使われますが（これについては後述します）、契約書では、一般に代表的な使われ方です。まずは、契約書においてperformanceが「履行」の意味で使われる場合を見てゆきます。その前に「履行」の意味を法律用語辞典で確認すると、「履行」とは、「一般用語では広く義務を遂行すること。法令では、一般用語の意味で使われるほか、債務者等が債務の内容を実現すること」とあります。
a) performanceが「履行」の意味で使われる場合の例
よく見られる例として、xxx of performanceは、performance（履行）の前にof、 inを付け、弁済期/履行期（time of performance）、履行地（place of performance）、履行遅滞（delay in performance）、履行不能（impossibility of performance）等があります。
The Contractor shall perform its services based on the terms and conditions of this Agreement. If the contractor fails to provide the services in the course of the performance of this Agreement, xxx（請負業者は、本契約の条件に基づいてサービスを履行するものとします。 請負業者が本契約の履行の過程においてサービスを提供できなかった場合、xxx）
なを、文脈的にperformance＝実行・遂行と訳す場合もあります。
b) performanceが「履行」以外の意味で使われる場合の一例
A performer has the exclusive right to record the sound and visuals of that performer’s performance.（実演家は、その実演を録音し、又は録画する権利を専有する。）（著作権法）https://www.japaneselawtranslation.go.jp/en/kwic
c）「履行」を意味する「performance」以外の英単語
ところで、「履行」を意味する「performance」以外の英単語がありますが、今回は、「fulfillment」を見てみます。
履行＝「fulfillment」動詞形は、「fulfill」
The Service Provider shall fulfill its obligations in accordance with the terms of this Agreement. （サービス提供者は、本契約の条件に従って義務を履行する。）この部分「shall perform」としても使えます。
If a fund contributor fails to fulfill their commitment to contribute, the subscription to funds ceases to have effect. （基金の引受人が拠出の履行をしないときは、基金の引受けは、その効力を失う。）（一般社団法人及び一般財団法人に関する法律）https://www.japaneselawtranslation.go.jp/en/kwic
The Seller shall reserve sufficient production capacity and maintain sufficient inventories to promptly fulfill orders.（売主は、注文を迅速に履行するために十分な生産能力を確保し、十分な在庫を維持する）
なを、当然ですが文章の内容と文脈から「fulfill」=「履行する」とはしないこともありあます。
思いつきですが、2つほど例文を作ってみました。
The Supplier shall maintain at its own expense a sufficient amount of spare parts adequately to fulfill the needs of its customers.（サプライヤーは、顧客のニーズを満たすのに十分な量の予備部品を自費で維持する）
以下の例では「perform」と「fulfill」入れ替え可能ですが、見た感じ、収まりが良いので、この形にしてみました。
The Contractor shall perform the services set forth in this Agreement and fulfill all other obligations specified herein.
「fulfill」は「performance」と同様に「実行・遂行」とされる場合もあります。

そのほか、implementation、carry out、execute, discharge等も文章の内容と文脈から「履行」、「実行」、「遂行」と訳される場合があります。これらについては、別の機会に見てみたいと思います。また、今回は、「performance」について「履行」とい意味にしぼってみていましたが、当然のことですが実際には、英文契約書や法律文書では、「履行」以外の意味で使われる場合もあります。この点については、別の機会に述べます。
