前回の「英文契約書の用語・単語 performanceについて」の続きです。今回は、契約書ではありませんが法律文の英訳に見る「performance」です。いずれも日本語の法律を英訳したものですが、内閣府の法令翻訳データベースに、「performance」についての幾つかの興味深い例がありました。日本の法律文の英訳に見る「performance」の用法についての視点からになります。この中で「performance」については、日常的に使用される「性能」や「公演」という意味の他に法律の内容や文脈上から「受領」、「履行」、「弁済」、「給付」等の意味で使用されています。いくつかの例を見てみます。（日本語の法律の英訳という視点からみたもので、契約書翻訳の際の何らかの参考になるかはわかりませんが）
- performance: 性能・実演
A person who intends to undergo a performance evaluation conducted by the Minister of Internal Affairs and Communications pursuant to the provisions of paragraph (1) must pay the amount of fees which is specified by Cabinet Order in consideration of the actual costs to the State.（第一項の規定により総務大臣の行う性能評価を受けようとする者は、実費を勘案して政令で定める額の手数料を国に納付しなければならない。）（消防法）
A performer has the exclusive right to make that performer’s performance available for transmission. （実演家は、その実演を送信可能化する権利を専有する。）（著作権法）
- performance: 弁済
When a prima facie showing was made that the petitioner is unable to obtain full performance of the secured claim set forth in the preceding item even by implementing exercise of a security interest against known property.（知れている財産に対する担保権の実行を実施しても、申立人が前号の被担保債権の完全な弁済を得られないことの疎明があつたとき。）（民事執行法）
An obligee that has received full performance by way of subrogation must deliver to the subrogee the instruments regarding the claim and any collateral that the obligee possesses.（代位弁済によって全部の弁済を受けた債権者は、債権に関する証書及び自己の占有する担保物を代位者に交付しなければならない。）（民法）
「弁済」については、以前は、「reimbursement」が一部使われていたような記憶があります。
- performance: 受領、履行、弁済
この例では、「performance」を英文の上から「受領」、「履行」、「弁済」としています。
provided, however, that if the obligee refuses to accept that performance in advance or if any act is required on the part of the obligee with respect to the performance of the obligation, it is sufficient for the obligor to request the acceptance thereof by giving a notice that the tender of the performance has been prepared.（ただし、債権者があらかじめその受領を拒み、又は債務の履行について債権者の行為を要するときは、弁済の準備をしたことを通知してその受領の催告をすれば足りる。）（民法）
ここでは「弁済」が「payment」、「履行地」が「the place of the performance」
If the amount of the claim is designated in the currency of a foreign state, the obligor may make the payment in Japanese currency converted with the foreign exchange rate at the place of the performance.（外国の通貨で債権額を指定したときは、債務者は、履行地における為替相場により、日本の通貨で弁済をすることができる。）（民法）
そのほか、「performance」が給付の意味で使われています。
Education assistance shall be provided by way of performance in money;（教育扶助は、金銭給付によつて行うものとする。）
Medical assistance shall be provided by way of performance in kind; （医療扶助は、現物給付によつて行うものとする）
「給付」に対応する英単語は、和英辞典を見ると名詞はpayment、conferment、provision、a benefit（社会保険等の給付）等、動詞はpay、confer、provide等とあります。「performance」は、見受けられません。
そこで、国語辞典で「給付」の意味を調べると「金品を支給・交付すること」、「債務者の債務の内容、および、それを履行する行為」とあります。さらに法律用語辞典を見ると、「一般的には、債権の目的となる債務者の行為」とあり、その内容は、「金銭等の交付、役務の提供」、その性質に応じて、「作為、不作為、可分、不可分、反対、保険の給付」等とあります。
さらに英英辞典を見ると「performance」は以下のように解説されています。
「the action or process or carrying out or accomplishing action, task or function.」

accomplishment or achievement act or carrying out, completion, conduct, consummation, discharge, execution, exploit, feat, fulfillment work.
action conduct, efficiency, functioning, operation, practice, running, working

法律英単語を見ると、「契約に従った義務の完全な遂行」とありました。
これらから考えて、あくまでも私見ですが、「金銭等の交付、役務の提供」という意味合いからそれぞれperformance in money（金銭給付）およびperformance in kind（現物給付）としたのではないでしょうか。
余談ですが、条文は、「給付」を「payment or delivery（金銭等の交付、役務の提供）」として表し、「performance」を弁済の意味で使用している例を見つけました。
If the obligor is to effect performance in exchange for payment or delivery by the obligee, the obligee may not receive deposited thing without making that payment or delivery.
（債務者が債権者の給付に対して弁済をすべき場合には、債権者は、その給付をしなければ、供託物を受け取ることができない。）（民法）
今回は、法令翻訳データベースの例を引用しましたが、英単語は1つの単語に様々な「意味を備えています。「performance」に限らず、英単語を翻訳する場合、英文の内容、文脈から、常に慎重に訳出する必要があります。各引用については、著作権法第13条１号から４号の規定によるものです。
