契約書の定番の用語として「～の場合」があります。英文契約書の場合では、「～の場合」に相当する単語、用語、または「～の場合」に相当するフレーズとして、例えば、in case of ～、in case where、in case that、where、 if、in the event that、upon the occurrence ofなどがあります。この中で最も多く見受けられるのは、「if」や「in case ～」の様式です。
もちろん日常的にもこの表現はかなり見受けられます。

当然ですが、英単語の常として、一般に1つの英単語は様々な意味を持っています。
例えば、辞書を見るとifの意味をいくつかあげると、仮定、条件文としての「もし…ならば」、「…の場合には」のほかにも「もし…ならばいつも＝whenever」、「たとえ…だとしても＝even if」、「…かどうかを＝whether」などがあります（これ以外にもあります）。
I wonder if it is true. What will we do if we fail?
If it had not been for their effort, I couldn’t have achieved this project.
英文契約書などでも「if」が「～の場合」として使われる以外にも、文脈的に上記の意味（「～の場合」以外の意味）で使用されます。例えば、
英文契約書でも、例えば、All information provided by the Customer shall be deemed the Confidential Information even if not so designated（機密情報として指定されていない場合も、顧客から提供されたすべての情報は、「機密情報」とみなされる）。
本題に戻ります。ここでは、「if」を使った「～の場合」について、一部、過去に掲載したブログで作成し例文を記載しました。契約書翻訳の視点からみてみます。
1. ifを使った場合
If the Parties are unable to resolve their dispute through bona fide negotiations, all disputes, controversies or claims arising out of this Agreement shall be finally settled by arbitration in accordance with the commercial arbitration rules of the Japan Commercial Arbitration Association in Tokyo under laws of Japan. （両当事者が、誠実な交渉による係争の解決をなし得ない場合、本契約から生ずるすべての係争、論争もしくは申し立ては、日本商事仲裁協会の商事仲裁規則に従い、日本法の下で、東京において仲裁により最終的に解決されるものとする。）
The Contractor shall provide any service other than those of the services specified herein, if requested by the Company. (契約者は、当会社から要請があった場合、サービス以外のサービスを提供する)
2. in case ～の場合
In case of subletting, the subtenant shall be expressly subject to all of the obligations of Tenant under this Lease.（転貸の場合、転借人は、本賃貸借契約に基づくテナントのすべての義務を明示的に負う）
The Warranty under this Agreement shall not apply in the case of failures of the Products due to any defect of the Products. （本契約に基づく保証は、製品の欠陥による製品の不具合の場合には適用されない）
The Fair Trade Commission must designate in advance an acting chairman from among the commissioners in case where the chairman cannot execute the chairman’s duties.（公正取引委員会は、あらかじめ委員のうちから、委員長が故障のある場合に委員長を代理する者を定めておかなければならない）
3. in the event thatの場合
In the event that the Receiving Party received any information from the Disclosing Party, such information shall be automatically categorized as the Confidential Information.（受領当事者が開示当事者から何らかの情報を受け取った場合、当該情報は自動的に機密情報に分類される）
In the event that a director is declared bankrupt, such director shall resign immediately.（取締役が破産宣告を受けた場合、当該取締役は直ちに辞任しなければならない）
「In the event」に関連して、以前「文頭の否定」というブログの中で「In no event ～」というパターンについて取り上げたことがあります。
In no event shall ABC Corporation be liable for any damages caused by or in relation to this Service.（いかなる場合も、ABC Corporationは、「サービス」に起因する、または関連する損害賠償に対して責任を負わない）通常の否定文にすると「In any events, ABC Corporation shall be not liable for any damages caused by or in relation to this Service.」
4. upon the occurrence ofの場合
Either party may terminate this Agreement by written notice thereof immediately upon the occurrence of one of the following events:(いずれの当事者も、次のいずれかの事象が発生した場合、直ちに書面による通知により本契約を解除できる)
Upon the occurrence of any of the events stipulated in this Article, a party may declare that any and all obligations of the other party under this Agreement become immediately due and/or payable.（本条に規定の事件が発生した場合、当事者は、本契約に基づく相手方のあらゆる債務は直ちに支払い期日が到来し、および/または支払われるべく宣言することができる)
「upon the occurrence of」については、あまり意識していなかったので、調べてみると以外と多く使われています。覚えておいて損はないフレーズです。
ifに代わる表現の例
「if」について触れたので、英文契約書では、使われることはほぼないと思いますが、「if」の持つ意味の1つ「～の場合」に類似した仮定を表す言葉として、例えば、「with: ～があれば」、「without、but for: ～がなければ」等があります。
With a little luck, you would succeed.
Ｗithout your assistance, we should fail.
But for the founds contributed by many people, this project has been failed.
例によって思いつくままを書いてみました、基本は、文法的なことはなるべく抜きにして、いつものことながら英文契約書に触れる時に覚えておくと便利な用語・単語について「～の場合」に焦点をあてて簡単にみてみました。
