契約書翻訳の際に英文契約書で目にする「規定する」、「規定されている」、「定める」という表現は、いずれも契約書や法律文書の頻出用語の1つです。これらの意味を表す主な単語は、provide、regulate、stipulate、prescribe、define、specify、set forth等があります。これらの単語・用語について、作成した例文（法律文を除く）を通して知っておくと便利な点にしぼって見てみます。
1. provideを使用したもの
一般にfurnishと並んで「提供する」の意味として理解されている場合も多いかもしれません（主観的な意味としてですが）。ちなみにこの名詞形である「Provision」は、供給、提供、食料、用意、準備、規定、条項等の意味があります。
「provide」について辞書に記載の意味（法律分野）を見ると、「～を（規則・但し書きなど）で定める。規定する（約定する）」とあります。
英文契約書では、文脈的に「規定する」の意味で使用されるケースが多く見受けられます。もちろん、英文契約書においても「提供する」の意味で使用されることも多々あります。
This Agreement provides the Contractor’s obligations under this Agreement. （本契約は、本契約に基づく契約者の義務を規定する）
Any matter not provided for in this Agreement shall be settled based on a consultation between the parties hereto in good faith. （本契約に定めのない事項については、本契約の当事者間で誠意をもって協議し、解決するものとする）
Except as otherwise expressly provided herein, this Agreement may not be assigned to third parties without the consent of the other party hereto.
The Contractor shall provide the Customer with the services under this Agreement. （請負業者は、本契約に基づいて顧客にサービスを提供する）
2. specifyを使用したもの
「specify」について辞書に記載の意味（法律分野）をみると、「～を指定（特定）する。具体的に述べる，明記（詳述）する。」とあります。
英文契約書でも、「指定する」、「明確にする」、「明記する」などに意味で使用されますが、以下の例文のように「規定する」、「規定されている」の意味でも使われます。
“Site Manager” means the person who shall perform the duties specified in the Attachment. （「現場管理者」とは、別紙に定める職務を遂行する者をいう）
If the Contractor fails to comply with its obligations specified in this Agreement, the Customer may terminate this Agreement specified in this Agreement. （請負業者が本契約に規定された義務を遵守しなかった場合、顧客は、本契約で指定された本契約を解除できる）
そのほか、副詞としてspecificallyの形で、「明確に」、「具体的に」、「特に」の意味でも使われています。The Company shall not disclose any Confidential Information to any person or entity other than as specifically permitted by this Agreement. （会社は、本契約において明示的に許可された以外のいかなる個人もしくは存在に対しても、いかなる機密情報も開示しない）
3. regulateを使用したもの
「regulate」について辞書に記載の意味（法律分野）をみると、「～を（規則・方法などで）規制（規定する）」とあります。ラテン語の「regere = to rule, guide(支配する, 統治する)」に由来しています。名詞形は、「regulation」規則、規制、取り締まり、規定、規範、条例、調節、調整等の意味があります。日常的にもこの言葉は、通常「調整する」、「規制する」などの意味で使われることが良く見られます。
The service engineers regulate the machine every three months.
The furnace temperature is always regulated.
「調整する」の場合、「regulate」を使うと固い表現になるようで、「adjust」とか「tune」を使うケースが多く見られます。It is necessary to fine-tune the vacuum pressure on the input side of the equipment.
The Government issues a new atmospheric pollution prevention act that more strictly regulates air pollution in comparison with the current the laws and regulations. （政府は、現行の法規制に比べて大気汚染をより厳しく規制する新しい大気汚染防止法を公布する）
The Management Committee are entitled to regulate and investigate the matters dealt with in this Agreement.
契約書・法律文書で「regulate」が文脈的に「規定する」の意味で使用される例としては、
The Contract of Employment shall regulate the rights and obligations of the employees.（雇用契約は、従業員の権利と義務を規定する）
This paragraph regulates to prevent unjust sales regarding the Products under this Sales Agreement. （本項は、本売買契約に基づく商品の不当な販売を防止するために規定する）
4. stipulateを使用したもの
辞書に記載されているこの言葉の主な意味は、動詞として「～を規定する」、「～を明記する」、「～を約束する」、「～を請け負う」です。ラテン語のstipulatus、stipulari（約束を要求する、取引をする）という動詞の過去分詞形に由来します。
この言葉の名詞形「stipulation」は、「規定化」、「明文化」、「条項」、「条件」の意味を持ち、契約において、特定の条件や要求が明確化されることを意味します。そのほかstipulate forとして「～を要求する」などの意味があります。
The trademark of the manufacturer shall be stipulated in all products to be sold in the its domestic markets. （製造業者の商標を、国内市場で販売されるすべての製品に明記する）
All raw materials and parts stipulated in this paragraph supplied by the customer to the manufacturer shall be deemed to be the customer’s property. （顧客が製造業者に提供する、本項に規定するすべての原材料および部品は、顧客の所有物とみなされる）
「～を規定する」の意味で使用する場合、文脈的に「～を定める」とする場合もあります。
The delivery schedule of the Products shall be stipulated in each separate agreement.（製品の納期は、それぞれの別途契約に定める（規定する）ものとします。）
City Plans Stipulated by the Minister of Land, Infrastructure, Transport and Tourism. （国土交通大臣の定める都市計画）（都市計画法）
5. prescribeを使用したもの
ラテン語の「praescribere； prae＝before（前に）、scribere＝write（書く）に由来します。「prescribe」について辞書に記載の意味（法律分野）をみると、「～ということを規定する、～に対して取得時効の権利を主張する（請求権・訴訟などが）（消滅）時効で無効になる（時効にかかる、時効になる）」とあります。
この言葉は、日常的には「（薬などを）処方する」などの意味で使われることが多いかもしれません。ちなみに名詞のprescriptionは、「規定」、「指示」などの意味のほかに「（医師の）処方箋）」の意味もあります。文脈的に「定める」とすることもあります。なを、法律でいう「時効」も多くはprescriptionを使用します（他の用語もあります）。
Specifications means any specifications prescribed by the manufacturer from time to time for or in relation to the Products. （仕様とは、製品に関して、または「製品」に関連して、その時々において（随時）製造業者が規定する（＝定める）仕様を意味する）
Proxy shall be in the form prescribed under the Act. 「規定する」（委任状は法律に規定する（定める）様式による）
Either party may terminate this agreement by giving the other party six (6) months’ written notice before the end of the initial period or any subsequent renewal period prescribed herein.（いずれの当事者も、本契約に規定されている当初期間またはその後の更新期間が終了する6か月前に書面で通知することにより、本契約を終了することができる）
The competent minister shall prescribe required items in relation to accounting of net asset amounts in addition to the items set forth in the preceding paragraphs. （前各項に規定するもののほか、純資産額の計算に関し必要な事項は、主務大臣が定める）（商品先物取引法施行規則）
そのほか「所定の」の表現で使用されることもあります。「所定の」の表現は「fixed」、「appointed」、「designated」,「stated」などを使う場合もあります。
If the Employee has been working for six (6) months and reported for work more than eighty (80) percent of the prescribed working days since he or she joined the Company, ten (10) days of the annual paid leave shall be granted.
The warranty of the Product prescribed under this Agreement may not apply if any failure is encountered within the period fixed in the warranty period therein.
6. defineを使用したもの
語源は、ラテン語の「definio＝制限する；境界を付ける」や古期フランス語の「definer＝定義する」と言われています。英和辞典でみると仕事・立場（の意義を）はっきりと規定する、明確に定める、明示するとあります。たしかにこの言葉は、契約書に限らず、また分野を問わず「定義する」とか「明確にする」という趣旨の意味で知られている場合が多いと思います。文脈的に「規定する」とされることがあります。
「define」は、言葉として固いイメージがありますが、日常の文章や会話でも良く使われています。

Language is meant to have a definite meaning for a word or that word is sometimes meaningless in some situations.（言語は、単語に対して明確な意味を持つように意図されているが、その単語は、時としてある状況ではその単語は無意味になってしまう）
メモ：「define」の名詞形「definition」は、英文契約書では、「definitions」として「定義条項」として記載されていることは良く知られています。第一条に置かれることが多いようですが、それ以外の場所に置かれるケースもあります。また、定義する事柄を定義条項ではなく文中で定義するケースまたは定義条項での定義と文中での定義の組み合わせなども見られます。ある文言に正確な定義を与えることにより、当事者間の解釈の違いから生じる紛争を予防するという意味においては同じ効果を狙っています。
「規定する」、「規定されている」という表現についての例を作成した例文でみてみます。いずれも文脈的な観点からその時々で「定義する」、「規定する」、「定める」等とします。
This paragraph shall in no way define, limit, or extend in the construction of the scope, or intent of this Agreement.（本項は、本契約の範囲または意図の解釈に対する一切の定義、限定もしくは拡張するものではない）
The manufacturer will periodically re-define the concept of and improve the performance of and quality of the products according to the specifications based on this Agreement. (メーカーは、本契約に基づく仕様に従って定期的に製品の概念を再定義し、製品の性能と品質を向上させる)
The Contractor and the Customer may revise or newly define the rights and obligations contained in this Agreement in writing based on coordination between the parties. （契約者と顧客は、当事者間の協議に基づいて、書面により本契約に記載の権利と義務を改訂または新たに規定することができる）
The purpose of this Memorandum is to establish the appropriate responsibility, authority and interrelation of all relevant personnel and define the independence and authority to perform the tasks herein.（この覚書の目的は、すべての関係者の責任、権限、および相互関係を適切に確立し、本覚書におけるタスクを実行するための独立性と権限を規定（定める）するものである）
7 set forthを使用したもの
ラテン語の「secta（方法など）」に由来する古フランス語です。英和辞典には、「通常受け身で）～を（十分に）（～に）説明する（意見などを述べる）、～を声明する、宣言する」とあります。この言葉には「規定する」という意味ももちろんありますが、単に「記載されている」、「記載する」、「説明する」とすることもあります。
There are no restrictions, promises, covenants, or understandings between the parties hereto other than those expressly set forth in this Agreement。(本契約に明示的に規定されているものを除き、本契約の両当事者間に制限、約束、誓約、または了解はない)
The parties hereto shall comply with the requirements set forth in schedule attached to this Agreement. (本契約の両当事者は、本契約に添付のスケジュールに記載の要件を順守する)
For the purpose of this Agreement, the following terms have the meanings set forth below（本契約の目的において、以下の文言は、以下に規定する意味を有する。）
「set forth」は、正確には、「set forth」の前に「which is (are)」がつきますが、多くの場合、「which is (are)」は省略されるせいか、「which is (are) set forth in」と書かれているものはほとんどみかけません。
Either party may terminate this Agreement by giving a written notice to the other party even in the middle of the period set forth herein if a party violates the provisions thereof.（いずれかの当事者が本契約の規定に違反した場合、本契約に定める期間の途中であっても、相手方に書面による通知を行うことにより、本契約を解除できる）
各単語の使い分けについては、例えば「stipulateは、契約や合意の条件として何かを要求することを指す」「prescribe、法律や規則によって何かを命じることを意味する」、「regulate」は権限を持つものによって設けられたルールであり、そのルールに従って行動しなければならない、という強制的な性格がある」とする解説もありますが、実際のところは、任意につかわれているようです。
今回のまとめについては、「規定する」、「規定されている」という表現とこれらの類似表現も含めて、以前英文契約書の用語・単語－「規定する」の表現（その1～その3）で取り上げたことがあります。今回、これらに加筆・修正したものを契約書翻訳の視点からまとめてみました。
