今回は、fileをとりあげてみました。「file」という単語からまず思い浮かべるのは、書類を整理したり、綴じたりした「ファイル」やまとめた書類の束やワードとエクセルのファイルのこととして、日常的には日本語として使われています。あるいは、「file」の動詞として使い方の中の1つで、「やすりをかける、削る」などがあります。このほか「file」の意味については、英単語の例にもれず様々な意味があります。その中でも今回も主に契約書や法律文書で主に使われる意味を中心に、契約書翻訳の視点からとりあげてみます。
契約書や法律文書に多く使われる「file」の用法の1つは、動詞としての「提出する」、「申請する」、「出願する」の意味です。その意味では、「file」は、契約書や法律文書等の必須単語の1つです（日常的な言葉としても使われます）。

The party concerned shall be responsible to file all Tax Returns that it was required to file. （関係者は、提出が要求されたすべての納税申告書を提出する責任を負うものとします。）

- 「提起する」、「申し立てる」
The parties of this Agreement shall agree that filling of suit arising out of or related to this Agreement shall be submitted to the Tokyo District Court as the agreed exclusive competent court for the first trial. （本契約の両当事者は、本契約に起因する、または関連する紛争につき訴訟を提起するときは、東京地方裁判所を第一審の専属的合意管轄裁判所とすることに合意する。）
The both parties hereto agree that Lawsuit may be filed based on the legal grounds.（両当事者は、法的根拠に基づいて訴訟が提起される可能性があることに同意します/両当事者は、法的根拠に基づいて提訴される可能性があることに同意します。）
If either party files a petition in bankruptcy, civil rehabilitation proceedings or corporate reorganization proceedings, etc., or if a petition in bankruptcy, civil rehabilitation proceedings or corporate reorganization proceedings, etc. is filed against it.（いずれかの当事者が破産、民事再生、会社更生等の申し立てをし、又は受けたとき）

「file」について、英文契約書多く目するに使われ方のいくつかついてつれづれに書いてみました。実際には、さらに多くの使われ方があり、構文的にも複雑な内容に出会います。
