契約書翻訳の視点から以前に書いた、「英文契約書の用語の定番の「従う」または「遵守する・順守する・守る」という用語・単語（その1）、（その2）」」について、「まとめ」として加筆、修正したものです。いずれの言葉も日本語では、日常的に「従う」も「守る」大体が同じ意味として使用されます。ただし、翻訳の場合、英語から日本語への翻訳でも、文脈に応じて、同じ単語を、適宜、これら意味に振り分けて訳出する場合が多くあります。同様に日本語から英語への翻訳の場合も、文章の内容と意図に応じて、「従う」、「遵守する・順守する・守る」に対応する単語を、適宜使い分けます。ここでは、とりあえず知っておくと良いいくつかの単語・用語を英文契約書翻訳の視点から見てみます。なお、単語と作成し例文に付記された訳語は、基本的に暫定訳、または仮訳です。
1.「従う」
「従う」それ自体、日本語としても様々な意味があります。英語の単語、用語でも「従う」の意味を単語・用語、または「従う」と訳される単語・用語は多くありますが、ここでは、英文契約書、法律文で「決めたことや規則に従う」の意味で使われる中から、とりあえず知っておくと便利ないくつかのパターンを取り上げます。
a. 日常的な例：
I follow his advice. Most people follow customs in this local community.
I accept his request.
ｂ. 技術文書で見かける例：
Operator must follow the proper procedure to turn off the machine in order to prevent data corruption on the machine hard drive. （オペレーターは、装置のハードドライブのデータの破損を防ぐために、装置をOFFにする場合、適切な電源OFF手順に必ず従ってください。）
c. 「従う」を意味するいくつかの用語・単語
accept：（受け入れる、従う）
abide by ：（法律・協定。規則などに）従う
follow: 「（忠告･命令･慣習などに）従う」
obey：(命令･法律などに)従う
observe: (命令･法律などに)従うfollow：（忠告･命令･慣習などに）従う
comply with：（命令・規則・要求などに）従う
in accordance with：（～に従う、～に従って）
in agreement with：（～に従って）
in substantial accordance with (実質的に従って)
conform to:（慣習・しきたりなどに）従う
in conformity to（with): （～に従って）
in deference with：（～に従って）
in obedience to：（～に従って）
pursuant to、in pursuant of: （～に従って、～に応じて」、～により）
いずれも、「従う」または「遵守する・順守する・守る」としてそのまま使えるものです。
ところで、英文和訳の場合、これらの単語は、訳出した場合、上記のように（～に従う、～に従って）と同じように訳される場合がほとんどですが、和文英訳の場合は、文脈に沿った単語・用語を選択することを必要とする場合が多くあります。
作成した例文を通していくつか見てみます。
The employees shall obey and observe all rules and regulations reasonably established by the Company from time to time. （従業員は、会社が合理的に定めたすべての規則および規定を随時遵守しなければならない）
The Licensee shall operate fully to comply with the liabilities arising from this Agreement. （ライセンシーは、本契約から生じる責任を遵守するためにその義務を完全に遂行する）
Each party hereto agrees to comply with its obligations under this Agreement. （本契約の各当事者は、本契約に基づく義務を遵守することに同意する）
The Contractor will abide by all laws applicable to its provision under this Agreement and is responsible for any fees or permits necessary therefore. （契約者は、本契約に基づく規定に適用されるすべての法律を遵守し、そのために必要な料金または許可について責任を負う）
The Licensor grants to the Licensee for the duration of this this License Agreement a non-exclusive license to use the Mark as a trade mark on or in relation to the Products in Sales Territory in accordance with the terms thereof. （ライセンサーは、本ライセンス契約の有効期間中、本契約の条件に従って販売地域内の製品または製品に関連してマークを商標として使用する非独占的ライセンスをライセンシーに付与する）
「accept」には、さまざまな意味（例：受け入れる、受納する、引き受ける、受諾する、応じる…：)があります。I accept his proposal. We accept the entrustment of businesses.
以下のように、文脈的に「従う」とすることもあります。If you do not accept our instruction specified in the separate agreement, you may not renew the basic agreement. (別途規約に定める当社の指示に従わない場合には、基本契約を更新することはできない)
指示に従わない＝「を受諾しない・に同意しない・を受け入れないなどでも可」。
The employees shall accept the workplace policies and procedures, instruction and supervising as well as the existing internally or externally code of conduct. (従業員は、職場の方針と手順、指示と監督、および既存の社内または社外の行動規範に従うものとする。）
If Party X fails to perform its obligations under this Agreement, Party Y may terminate this Agreement pursuant to the termination clause hereof. (当事者Xが本契約に基づく義務を履行できない場合、当事者Yは本契約の解除条項に従って本契約を解除できる）
The Contractor shall reimburse the expenses borne by the Customer to the Customer the pursuant to the provision under this Agreement. （契約者は、本契約の規定に従い、お客様が負担した費用をお客様に弁済する。）
「pursuant to」は、契約書や法律文の常套句です。良く知られているように「従う」の他に「～に応じて」、「～により」などとされる場合もあります。例えば、上記の例文も文脈的に「契約者は、本契約の規定により」とする場合もあります。
2.文脈的に「従う」として訳せるいくつかの言葉の例：
「subject」を使った例
「subject」そのものは様々な意味に使われ、なじみのあるところでは、「主題・事柄・（書物や作品などの）標題」ですが、「be subject to」は文脈的に「～に従って」とされることがあります。
This Agreement is subject to all applicable federal, state and local laws.
（本契約は、適用される連邦法、州法および地域法に従います（準拠します）。）
類似の表現：This Agreement shall be governed by and construed in accordance with the laws of Japan.
The prices of Products shall be reviewed periodically in accordance with prevailing market conditions and are subject to change or withdrawal without any prior notification at the sole discretion of manufacture.（製品の価格は、一般的な市場の状態に従って定期的に再検討を行い、事前の通告なしに、メーカーの単独の裁量により、変更撤回されることがある）
ブログの内容とは外れますが以下の文章も良くみかけます。
The specifications of this Product are subject to change without any prior notice. （本製品の仕様は予告なく変更される場合があります。）
「submit」を使った例
The parties hereto shall submit any dispute arising from this Agreement to the exclusive jurisdiction of the Tokyo District Court of Japan.（本契約の当事者は、本契約に起因する紛争については日本の東京地方裁判所の専属管轄権に服する（従う）。）「submit」には「～に服従する」の意味もあり。文脈的に「～に従う」としてみました。「専属管轄権に服する」などとすることもあります。
