契約書翻訳の視点から基本的な単語・用語を使って作成した例文を通して（法律文を除く）、英文契約書で使われる日にち、期日および期間についての使いかたを簡単に見てみます。。

英文契約書に限らず、契約書では、日にち、期日および期間が重要な要素です。例えば、ある契約がいつから開始して、いつ終了するのか、契約期間が終了した後、その契約を延長することがあるのか、その方法とは、代金の支払い日はいつか、代金をいつまでに振り込むか等、日にちについて、これらを含め、さまざまな重要な事柄があります。

1. 日にち、期日および期間の表わす単語・用語のいくつか

accounting year: 会計年度

accounting period:会計期間

base date:基準日

business day:営業日

calendar day:暦日

calendar year: 暦年

calculation date: 算定基準日、起算日

commencement date：開始日；start date

due date：支払い期日、債務履行期日、納期、弁済期、期日、期限

effective date:発効日

effective period: 有効期間

expiration date: 満了日

fixed date: 確定日

holiday：休日

maturity date：償還期日

payment date：支払日

ここにある言葉と他の言葉を組み合わせたものを含め、これらのほかにも、さまざまな日にちや期間を表す言葉があります。（例：due date for the payment：弁済期限、claim with a due date：期限付債権、uncertain due date：不確定期限 the delivery due date:納品期日）

2. 契約の開始日および契約期間の例

英文契約書に限ら、契約書で期日および期間の例として、思い浮かぶのは「契約開始日と満了日」についての記載です。

The effective period of this Agreement shall be from xx xx, 2023 to xx xx, 2024.

This Agreement shall last for one (1) year from the date of the execution of this Agreement.

This Agreement shall commence from the effective date and expire after three (3) years therefrom.

This Agreement shall come to in effect on xx xx, 20xx and shall remain in effect for three (3) years unless sooner terminated pursuant to the terms hereof.

This Agreement shall be effective from the 1st of January, 20xx and remain in full force for the period of xx years from that date.

This agreement shall be in effect for a period of five (5) years, from xx xx, 20xx to xx xx, 20xx.

契約の期間については、以前、英文契約書の条項　一般条項：「Definition（定義）」と「Term（期間）」で取り上げことがあります。

3. 支払い期日等についての例のいくつか

The Seller shall deliver the Products to the Buyer’s warehouse by the delivery due date and the Buyer shall pay the prices of the Products specified in the Exhibit of this Agreement by the due date after inspecting the Products. （売主は納品期日までに製品を買主の倉庫に引き渡すものとし、買主は製品を検査した後、期日までに本契約の別紙に指定された製品の代金を支払う）

If this Agreement is terminated, all sum of due by the Buyer to the Seller shall be immediately due and payable regardless of the due date specified in this Agreement and the Buyer shall immediately pay them. (本契約が終了した場合、本契約に指定されている期日に関係なく、買主が売主に支払うべき全額が直ちに支払われるものとし、買主は直ちにこれらを支払う)

In this case, the date of the public notice is deemed to be the fixed date.

（この場合においては、当該公告の日付をもって確定日付とする）（保険業法）

4. その他の日にちの例のいくつか

The User shall pay the Fee of subscription under this Agreement within ten (10) business days after receipt of the invoice issued by the Service Provider.

The business day means Monday through Friday excluding the Japanese national holidays.

日にち、期日および期間に関する単語と用語について覚えておくと便利な事柄を簡単に取り上げてみました。契約の開始日および契約期間等も含めて、もう少し掘り下げることがある内容ですが、いずれかの機会にしたいと思います。このブログはメモ的な感覚で書いています。内容を参考にされる場合は、辞書・専門書をご確認の上、ご自身の責任でお願いします。

契約書翻訳の視点から知っておくと便利な良く目にする言葉を取り上げています。契約書は当事者間の権利と義務を規定します。以前、「「責任」や「義務」を意味する用語の例として、Responsibility、Obligation、Liability、Dutyについて取り上げましたが、今回は、権利者と義務者を表す用語について見てみます。

「権利者」と「義務者」という言葉というタイトルで書いていますが、「権利者」と「義務者」という言葉は単体で目にするよりも、多くの場合「～の権利者」、「～の義務者」のような使われ方をします。また、直接的に「権利者」と「義務者」という表現でなくても、例えば、債権者、債務者等のようにその言葉自体にその者や存在が「権利者」と「義務者」であることの意味をもっている場合も多くあります。

ところで「権利」とは、「一定の利益を追求し、主張し、享受することができる力。相手方に対して作為または不作為を求めることができる権能。相手方はこれに対応する義務を負う」（法律用語辞典）とあります。例えば、obligeeは、債権者ですが、AがBに対して一定の行為（給付）を請求できる権利を持つAを指し、Bはその給付義務を負う者である債務者： obligorとなります。債権者、債務者を表す英単語は、これら以外にも、例えば債権者であれば、creditorとか、債務者であればdebtorなどがあります。

1.　 「権利者」、「～の権利者」またはそれに類する意味を持つ用語のいくつかの例：

rightful claimant:正当な権利者

the person who holds the right：権利者（権利を有する人）

a rightful person：正当な権利者

proprietor：所有者

person entitled：権利者、権利を有する者

right holder：権利者

Beneficiary Certificate holders：受益証券の権利者

right holder：権利者

electronically recorded claim holder：電子記録権利者

execution creditor： 差押権者

garnisher： 差押債権者

obligee：債権者

 All intellectual property rights of this Product shall belong to the proprietor who holds a patent right thereof.

A person entitled to call a meeting of shareholders may at any time call an extraordinary general meeting of shareholders for any purpose.

If an obligor voluntarily fails to perform any obligation, the obligee may request the enforcement of specific performance from the court

2.　 「義務者」、「～の権利者」またはそれに類する意味を持つ用語のいくつかの例:

義務者は、法律上、特定の義務を負うべき人のことです。

obligor：債務者；義務者

debtor：債務者

Taxpayer：納税義務者

the person obliged to disclose：開示義務者

Person Liable to Pay Customs Duties：納税義務者

electronically recorded claim obligor：電子記録義務者

Person Responsible for Payment：支払い義務者

the person obliged to register：登記義務者

If an obligor voluntarily fails to perform any obligation, the obligee may request the enforcement of specific performance from the court; （債務者が任意に債務の履行をしないときは、債権者は、その強制履行を裁判所に請求することができる。）

Where a party makes a taxable supply to another party, the recipient must pay to the suppler an additional amount equal to the Consumption Tax based on the tax invoice received by the Recipient.（一方当事者が他方当事者に対して課税対象物を提供した場合、受領者は、受領者が受領したタックスインボイスに基づく「消費税」に相当する追加額を提供者に支払わなければならない）

Even after the obligee has made a demand to the principal obligor in accordance with the provisions of the preceding Article, the obligee must first execute on the property of the principal obligor if the guarantor proves that the principal obligor has the financial resources to pay the obligation and that the execution can be easily performed. （債権者が前条の規定に従い主たる債務者に催告をした後であっても、保証人が主たる債務者に弁済をする資力があり、かつ、執行が容易であることを証明したときは、債権者は、まず主たる債務者の財産について執行をしなければならない）（民法）

「権利者」、「～の権利者」、「義務者」、「～の権利者」または「それら類する意味を持つ言葉」について簡単に触れてみました。これらに関するいくつかの例をあげましたが、ほんの一例であり、ある特定の分野で用いられる言葉‐用語はこれら以外にも多くあります。

法令翻訳データベース

契約書翻訳をしていると英文契約書に「Survival」、「Survival of Certain Provision」、「Survival of Terms」、「Survival Provisions」などと題された条項を目にすることがあります。「存続条項」とか「Survival条項」とか称されています。呼称の仕方はともかくも、契約が解除されたり、または満了した場合でも、ある特定の条項の効力を存続させたい場合などに記載されます。存続させる条項について良く目にするのは、守秘義務とか機密保持、義務、表明とか保証に関するものですが、契約によりさまざまなものがあります。また、特に「Survival」と題する条項がない場合でも、ある条項に内容の一部として契約の解除・満了後もその条項の効力を存続させる旨の記載があることがあります。作成した簡単な例文を通していくつかの用例をみてみます。

1.　機密保持義務の存続

The obligations of the Confidentiality of the Receiving Party under this Agreement shall survive the expiration or termination of this Agreement.

2.　義務の存続

All obligations set forth in this Article shall survive the termination or expiration of this Agreement for any reason whatsoever.

上記、1，2とも、存続させる対象が異なるだけで、内容的は似たようなものです。

3.　表明や保証の存続

The representations and warranties of the parties hereto contained in or made pursuant to this Agreement shall survive the termination or expiration of this Agreement.

All warranties hereunder will survive the manufacturer’s Products and/or any products incorporating the manufacturer’s Products after change, termination or expiration of this Agreement.

4.　存続させる特定の条項や事柄を項目ごとに列記

The following terms will survive termination or expiration of this Agreement:

1. xxxxxxx,
2. xxxxxxx, and
3. xxxxxxx

本題とは関係ないのですが、上記例文に、「shall」と「will」を使いましたが、基本的に効力に差はないとされていますが、「will」よりも「shall」が好まれる傾向があるようです。

とりあえずこれも覚えておいて損はない事柄について簡単に見てみました。契約によりさまざまなものがあります。英文契約書について「Survival」に関連する実際の記述は、例文のように簡単な内容もありますが、時としてかなり複雑な構成の構文を目にすることがあります。翻訳に際しては経験や能力が問われる部分です。

契約書翻訳に限らず、「～を対象として」、「～を対象とする」という表現があります。例えば、日本語から英語にする場合、「対象」という言葉に対応する単語として、「target」、「subject」、「object」を思いつきます。和英辞典をみても「対象」という言葉に対応する単語として、上記の単語が掲載されています。

ところで、「対象」という言葉については、英日・日英の翻訳にかかわらず、文脈的に、該当する言葉や表現を適宜使用するケースも多くなります。

例えば、「研究の対象は何ですか」の場合、

「What is the subject of your research?」が直接的に「対象」＝「subject」を使用していますが、「what are you researching? 」とした場合でも「何を研究しているか」＝「研究の対象は何か」と文脈的にと訳されることもあります。

中には、文章の構成上、特に英訳場合など「target」、「subject」、「object」等をそのまま使用するのは適切でない場合もあります。「対象」という言葉は日常生活のいろいろな場面で使用されます。

いつもは契約書翻訳の視点から見てみていますが、今回は、作成した例文（法律文を除く）を通して、今回は、契約書にとらわれずに「対象」という言葉について日英の表現のいくつかを見てみます。

なを、国語辞典で「対象」の主たる意味をみると、「行為の目標となるもの。めあて」、「哲学で、主観・意識に対してあり、その認識や意志などの作用が向けられるもの」とあります。

先ずは、「target」の例から見てみます。

1.　 「target」を使う場合：

上記取締役会には対象会社の監査役の全員が出席し、対象会社の取締役会に賛同する旨の意見を表明した。

－All of the auditors of the Target Company attended that meeting and expressed their opinion in favor of the Target Company’s board of directors.

ただし、本公開買付けの期間中に、対象者が、(ⅰ)本公開買付けに対し賛同する旨の意見表明を変更した場合、

－However, if the Target, during the period of the Tender Offer, (i) cancels the announcement of agreement to the Tender Offer,

対象のソースファイルやバイナリファイルを選択すると、XXXに最適なアプリケーションを選択できます。

－When the target source file or binary file is selected, it is possible to select an application best-suited for a XXX…

この調査方法は、日本の科学技術の専門家を対象とした大規模なアンケートの手法として使用されてきました。

－This research method has been used in Japan as a technique for large-scale questionnaires targeted at experts in science and technology.

2.　 「target」を使わない場合：

本来「target」を使って「対象」を表す場合でも、「target」を使用しないで「対象となる、対象とした」を表現することがあります。

なお、各物件の投資比率を合計しても、各投資対象地域またはポートフォリオの合計の投資比率とは必ずしも 一致しません。

－It may not exactly match the investment ratio for each investment regions or for the overall portfolio.

この場合、投資の対象エリアということで、targetを使わずに「region」としてみましたが、以下のように使用することができます。

－「It may not exactly match the investment ratio for each region to be invested or for the overall portfolio.」としても（投資対象地域ごと、またはポートフォリオ全体の投資比率とは必ずしも一致しない場合がある）

環境と安全衛生のリスク評価の対象には、製造現場、倉庫・貯蔵施設、工場や設備の支援機材、研究所と試験エリア、衛生設備（化粧室）、キッチンとカフェテリア、従業員に提供される住宅や寮が含まれます。

－Areas to be included in a risk assessment for environmental health and safety are production areas, warehouse and storage facilities, plant/facilities support equipment, laboratories and test areas, sanitation facilities (bathrooms), kitchen/cafeteria and worker housing/dormitories.

この場合、「リスク評価の対象となる」を「Areas to be included in a risk assessment＝リスク評価に含まれるエリア」としました。

処理中のメッセージが表示され、補正対象として認識したエリアがオレンジ枠で表示されます。

－The display indicates that the image is being processed, and then the area recognized as the correction range is displayed with an orange frame.

この場合、「補正対象」を「the correction range：補正する範囲」をとしています。

The display indicates that the image is being processed, and then the area recognized as the range to be corrected is displayed with an orange frame.もあるかと思います。

このため、各インデックスフィールドにズームゾーンを定義し、フィールドの編集時にイメージ表示で 対象部分を自動的に ズームできます。

－The image display automatically zooms to the appropriate part of the image when that field is edited. この場合、対象部分をappropriate partとてみました。これは、The image display automatically zooms to the part of interest in the image view when that field is edited.することもできます。

提出内容に変更が生じた場合、または納入品（評 価 対象 製 品 群）に関し材料、工程などに変更が生じた場合は、再提出をお願いします。

－In case of any changes in submitted contents, or in materials and processes for deliverables (product group to be evaluated), please submit the form again.

これについては、上記の幾つかの例で示してありますが、すでに評価対象製品群は、product group to be evaluatedとなり、xxx対象のxxxは、「xxx to be 動詞の過去形」で表されます。

今回は、「target」について日本語から英語の訳文についてみてみました。「subject」、「object」を使用した「対象」を表す表現については、次回、または別の機会に見てみます。いずれにしても「対象」、「～を対象として」、「～を対象とする」の表現については、単純に、「subject ~」、「target ~」、「targeting ~」とするだけではなく、適宜、他の言葉・表現を使用し、英語から日本語または日本語から英語の翻訳に限らず、日本語の「対象」という表現にとらわれずに、内容・文脈に対応して適切な翻訳を行う必要があります。

契約書翻訳の視点から英文契約書翻訳の際によく目にする「define」、「set forth」についてみてみます。前回の「英文契約書の用語・単語　　「規定する」の表現（その2）」続きです。前回は、「stipulate」、「prescribe」」についてでした。

1.　defineについて

契約書に限らず、分野を問わず「定義する」とか「明確にする」という趣旨の意味で知られている場合が多いと思います。文脈的に「規定する」とされることがあります。

defineは、言葉として固いイメージがありますが、日常の文章や会話でも良く使われています。

Bad diet such as dietary restriction only is definitely bad habits

He definitely needs some money for taking leave for vacation.

Self-defining your health without medical involvement is not an easy task. (医療の関与なしに自分の健康を自己定義することは簡単なことではありません。)

There were some defining moments between Japan and U.S in final round of MLB tournament. (MLBトーナメントの最終ラウンドで、日米の間に決定的な瞬間がいくつかありました)

Language is meant to have a definite meaning for a word or that word is sometimes meaningless in some situations.（言語は、単語に対して明確な意味を持つように意図されているが、その単語は、時としてある状況ではその単語は無意味になってしまう）

Supervisors must define key management roles of his or her subordinates.

英文契約書の例を作成した例文でみてます。いずれも文脈的な観点からその時々で「定義する」、「規定する」、「定める」等とします。

This paragraph shall in no way define, limit, extend, or aid in the construction of the scope, or intent of this Agreement.（本項は、本契約の範囲または意図の解釈に対する一切の定義、限定、拡張もしくは支援を行うものではない）

The manufacturer will periodically re-define the concept of and improve the performance of the products according to the specifications based on this Agreement. (本契約に基づく仕様に従って、定期的に製品の概念を再定義し、製品の性能を向上させる)

The Contractor and the Customer may revise or newly define the rights and obligations contained in this Agreement in writing based on coordination between the parties. （契約者と顧客は、当事者間の協議に基づいて、書面により本契約に記載の権利と義務を改訂または新たに規定することができる）

The purpose of this Memorandum is to establish an appropriately responsibility, authority and interrelation of all relevant personnel and define the independence and authority to perform the tasks herein.（この覚書の目的は、すべての関係者の責任、権限、および相互関係を適切に確立し、本覚書におけるタスクを実行するための独立性と権限を規定するものである）

2.　set forthについて

「規定する」という意味ももちろんありますが、単に「記載されている」、「記載する」、「説明する」とすることもあります。

There are no restrictions, promises, covenants, or understandings between the parties hereto other than those expressly set forth in this Agreement。(本契約に明示的に規定されているものを除き、本契約の両当事者間に制限、約束、誓約、または了解はない)

The parties hereto shall comply with the requirements set forth in schedule attached to this Agreement. (本契約の両当事者は、本契約に添付のスケジュールに記載の要件を順守する)

For the purpose of this Agreement, the following terms have the meanings set forth below（本契約の目的において、以下の文言は、以下に規定する意味を有する。）

「set forth」は、正確には、「set forth」の前に「which is (are)」がつきますが、多くの場合、「which is (are)」は省略されるせいか、「which is (are) set forth in」と書かれているものはほとんどみかけません。

Either party may terminate this Agreement by giving a written notice to the other party even in the middle of the period set forth herein if a party violates the provisions thereof.（いずれかの当事者が本契約の規定に違反した場合、本契約に定める期間の途中であっても、相手方に書面による通知を行うことにより、本契約を解除できる）

「define」、「set forth」についてみてきました。契約書翻訳の観点からは、このような場合には、このような表現を使うという観点から見てゆく方法がありますが、このブログは、とりあえず覚えておくと便利というところで、場合によりメモ的な感覚で書いています。内容を参考にされる場合は、辞書・専門書をご確認の上、ご自身の責任でお願いします。

契約書翻訳の際に英文契約書でよく目にする「規定する」、「規定されている」という表現は、いずれも契約書や法律文書の頻出用語の1つです。もちろん技術文書をはじめその他分野でも使われていますが、今回も契約書翻訳の視点から「規定する」、「規定されている」または時として「定める」の意味を表すいくつかの英語表現を作成した例文（法律文を除く）を通して契約書翻訳の視点からみてみます。

以下は「規定する」、「規定されている」を表す主な単語です。

provide、regulate、stipulate、prescribe、define、specify、set forth= which is set forth

1. provideを使用したもの

一般にfurnishと並んで「提供する」の意味として理解されている場合も多いかもしれません（主観的な意味としてですが）。英文契約書では、文脈的に「規定する」の意味で使用されるケースが多く見受けられます。もちろん、英文契約書においても「提供する」の意味で使用されることも多々あります。

This Agreement provides the Contractor’s obligations under this Agreement. （本契約は、本契約に基づく契約者の義務を規定する）

Any matter not provided for in this Agreement shall be settled based on a consultation between the parties hereto in good faith. （本契約に定めのない事項については、本契約の当事者間で誠意をもって協議し、解決するものとする）

The Contractor shall provide the Customer with the services under this Agreement. （請負業者は、本契約に基づいて顧客にサービスを提供する）

Except as otherwise expressly provided herein, this Agreement may not be assigned to third parties without the consent of the other party hereto.（本契約に別段の明示的な規定がある場合を除き、本契約は、相手方の同意なしに第三者に譲渡することはできない）

2.  specifyを使用したもの

「指定する」、「明確にする」、「明記する」などに意味で使用されますが、以下の例文のように「規定する」、「規定されている」の意味でも使われます。

“Site Manager” means the person who shall perform the duties specified in the Attachment. （「現場管理者」とは、別紙に定める職務を遂行する者をいう）

If the Contractor fails to comply with its obligations specified in this Agreement, the Customer may terminate this Agree specified in this Agreement. （請負業者が本契約に規定された義務を遵守しなかった場合、顧客は、本契約で指定された本契約を解除できる）

そのほか、1つの例として副詞としてspecificallyの形で、「明確に」、「具体的に」、「特に」の意味でも使われています。

The Company shall not disclose any Confidential Information to any person or entity other than as specifically permitted by this Agreement. （会社は、本契約において明示的に許可された以外のいかなる個人もしくは存在に対しても、いかなる機密情報も開示しない）

3.  regulateを使用したもの

通常「規制する」、「調整する」などの意味で使われることが良く見られます。

The Government issues a new atmospheric pollution prevention act that more strictly regulate air pollution in comparison with the current the laws and regulations. （政府は、現行の法規制に比べて大気汚染をより厳しく規制する新しい大気汚染防止法を公布する）

The service engineers regulate the machine every three months.

The furnace temperature is always regulated.

実際、経験上も契約書でregulateが文脈的「規制する」、「調整する」の意味として使われる場面が多いように感じます。The Management Committee are entitled to regulate and investigate the matters dealt with in this Agreement. (管理委員会は、本契約で扱われる事項を規制および調査する権利を有する)

regulateが文脈的に「規定する」の意味で使用される例としては、

The Contract of Employment shall regulate the rights and obligations of the employees.

（雇用契約は、従業員の権利と義務を規定する）

This paragraph regulates to prevent unjust sales regarding the Products under this Sales Agreement. （本項は、本売買契約に基づく商品の不当な販売を防止するために規定する）

次回は、stipulate、prescribe、define、specify、set forthについて見てみます。

英文契約書に限らず、契約書でお目にかかる言葉として「～を優先する」の表現があります。一般には、例えば「取り決めAの文書」と「取り決めBの文書」があった場合、どちらの内容や条件を優先するかを規定する場合に使用されます。法律的側面はとりあえず置いて、ここではいつものように、知っておいて損はない使い方を作成した例文（法律文を除く）を通して契約書翻訳の視点から簡単に見てみます。

「～を優先する」の表現についての英語表現としては、特に英文契約書で多く見受けられるのは「supersede」と「prevail」ですが、これ以外にも、例えば「take precedence」、「priority over」とか、まれに「override」などが見受けられます。

1. supersedeを使用した例：

This Agreement shall supersede all previous oral or written agreements or arrangements between the Parties. （本契約は、両当事者間のすべての以前の口頭または書面による契約もしくは取り決めに優先する）

This Agreement shall supersede all prior agreements between the parties with respect to its subject matter. （本契約は、その主題に係わる両当事者間のすべての以前の契約に優先する）

This Agreement constitutes the entire agreement of the parties with respect to the subject matter of this Agreement and supersedes and replaces all written and oral agreements in respect hereof. （本契約は、本契約の主題に関して各当事者の最終的合意を構成し、本契約に関するすべての書面および口頭による合意に優先し、これらに代わるものとする）

上記いずれも、ごく一般的に目にするいわば一種の定型文です。書き方は、これ以外にもいろいろあります。

2. prevailを使用した例：

If the provisions of this Agreement conflict with the previous Memorandums prepared by the parties hereto, the provisions of this Agreement shall prevail. （本契約の規定が、本契約の当事者によって作成された以前の覚書と矛盾する場合、本契約の規定を優先する）

If there is any conflict between the terms of any warranty in the standard Terms and Conditions of Sale and the provisions of the Warranty set forth in this Agreement, the provisions of the Warranty hereof shall prevail. （標準販売約款の保証条件と本契約に規定された保証条項との間に矛盾がある場合、本契約の保証条項が優先する）

これも上記に作成した例文のように、いずれもごく一般的に目にする表現の一例です。

If the agreed interest rate exceeds the statutory interest rate, the agreed interest rate shall prevail. （約定利率が法定利率を超えるときは、約定利率による。）

3. その他の例：

Special Conditions set forth in this Agreement shall override the terms and conditions set forth in the Attachment.（本契約に定める特別条件は、別紙に定める条件に優先する）

「override」には文脈的に「無効」と解されるケースもあります。

No other provision in this agreement shall be construed to override the provisions of this paragraph.（本契約書のいかなる他の規定も、本項の規定を無効にすると解釈されない）

The Contractor shall give priority to the performance of the Contract for this purpose hereof.

(契約者は、本目的のために契約の履行を優先する)

This Basic Agreement shall take precedence over any conflicting terms and conditions which are set forth in any Purchase Order.（本基本契約は、注文書に記載されている相反する条件に優先する）

The rights specified in the laws and regulations shall replace the other rights set forth in this Article. （法律および規則で定められた権利は、本条に定められた他の権利に取って代わる＝優先する）；The rights specified in the laws and regulations shall supersede the other rights set forth in this Article.

実際には、これらの文章の他の条件は内容が組み合わされて、多少長めでやや複雑になる傾向がありますが、基本的な用法なので押さえておくと便利です。

これらの用語の日常的な使い方は、例えば「supersede」の場合、Flip phones have been superseded by smartphones.（ガラ携はスマートフォンに取って代わられた）とか、We will supersede old PCs by new ones.  Communications through SNS prevail in the world.
